Regulatory & MOH Disclaimer
This page is for HEALTHCARE businesses on Medivis. It sets out what Medivis is not — not a medical device, not a clinical record system — and where MOH obligations sit. Businesses in other sectors should read the Regulated Industries section of the Terms of Service.
Medivis Is a SaaS Platform — Not a Medical Device
Medivis is a software-as-a-service (SaaS) booking CRM: appointment scheduling, a WhatsApp conversation desk, and administrative reporting. It is not a medical device as defined under the Medical Device Act 2012 (Act 737) of Malaysia or any equivalent regulation.
Medivis performs no medical function — no diagnosis, no treatment planning, and no clinical decision support of the kind that would require medical device certification.
Not for Diagnosis or Treatment
⚠️ Important: Medivis must not be used to make or support a medical diagnosis, to prescribe treatment, or to provide clinical recommendations. Every clinical decision must be made by a qualified healthcare professional.
The AI agent handles administrative questions only — services, prices, opening hours, locations and appointment slots.
Clinic = Data Controller, Medivis = Data Processor
- The clinic is the data controller for all patient data in its Medivis workspace: it decides how and why that data is processed.
- Medivis is a data processor, acting only on the clinic's instructions.
- The clinic bears full responsibility for all clinical decisions and outcomes.
- Medivis provides the tools; the clinic is responsible for using them in compliance with applicable law.
Not a Clinical Record System
Medivis stores contacts, WhatsApp conversations, appointments and the clinic's own service and price list. It does not store clinical records.
- No prescriptions, diagnoses, consultation notes, laboratory results, medical certificates or clinical images are held in Medivis.
- There is no integration with any practice management system, and no clinical data is imported from one.
- There is no patient-facing portal. Patients interact with the clinic through WhatsApp; they never sign in to Medivis.
- Appointment notes are a free-text field for the front desk. Clinics are advised not to record clinical detail there, and Medivis does not treat that field as a medical record.
Limits of the AI Agent
- The agent answers from the clinic's own FAQ and price list. It does not consult a medical knowledge base and cannot answer a clinical question.
- A guard layer blocks medical-advice requests and hands the conversation to clinic staff instead of answering.
- Every AI reply carries the clinic's configured disclaimer, and every conversation can be taken over by a human at any point.
- The agent never writes a clinical record. Its only write actions are booking, cancelling or rescheduling an appointment, and updating contact details.
MOH Compliance
- Each clinic is responsible for complying with all applicable Ministry of Health (MOH) requirements, including medical record retention and reporting obligations.
- Because Medivis holds no clinical records, it neither satisfies nor interferes with a clinic's medical record retention duties — those remain entirely with the clinic and its record system.
- Where a platform feature conflicts with a regulatory requirement, the regulatory requirement takes precedence.
